What Louisiana requires

Effective February 1, 2026, Louisiana raised its notary bond from $10,000 to $50,000 (Acts 2025, No. 258) and eliminated the errors and omissions policy alternative. Every commissioned civil law notary who is not a licensed attorney must now carry a $50,000 surety bond renewed every five years. Louisiana civil law notaries have far broader powers than common law notaries elsewhere, which explains the higher penalty.

Louisiana law makes the bond a condition of the commission itself: the commissioning authority will not issue, or will not activate, the commission until the bond is on file. The bond is a faithful performance bond conditioned on the notary's honest and lawful discharge of every duty of the office. Any person who suffers a monetary loss because the notary failed in that duty, whether through negligence, an improper acknowledgment, a defective identification of a signer, or outright fraud, may make a claim against it up to the $50,000.

Filing the bond in Louisiana

Louisiana notaries hold lifetime commissions but must file a new five-year bond with the clerk of court of the parish of residence before each bond expires. Failure to keep the bond current suspends the notary's authority to act.
